Acceptable Use Policy (AUP)

Provider: Nona Consult LLC ("Fuyonet", "we", "us", "our"), operating fuyonet.com.
This Acceptable Use Policy governs your use of all Fuyonet hosting, virtual server, and dedicated server services (the "Services") and is incorporated into and forms part of our Terms of Service. Violation of this AUP is a material breach of the Terms and may result in throttling, suspension, or termination without refund, and reporting to law enforcement where appropriate.
This AUP applies to Shared Hosting and to VPS/dedicated Servers alike. On Servers you administer, you remain responsible for the conduct of all users, resellers, and processes you permit.
1. Prohibited Content
You may not use the Services to store, host, transmit, or link to:
- Content that is illegal under U.S. federal or Wyoming law, or under the law applicable to your own activities.
- Child sexual abuse material (CSAM) or any child exploitation content — zero tolerance. Such content is reported immediately to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement, and the account is terminated.
- Content that infringes the copyright, trademark, patent, trade secret, or other intellectual property or privacy rights of any party.
- Malware, viruses, worms, trojans, ransomware, exploit kits, or other malicious code, and content designed to distribute them.
- Phishing pages, fraudulent or deceptive content, or content designed to steal credentials or personal data.
- Content that threatens, harasses, defames, or incites violence, or that promotes terrorism.
2. Prohibited Activities
You may not use the Services to:
- Gain or attempt to gain unauthorized access to any system, network, or account (hacking, cracking, credential stuffing, privilege escalation).
- Conduct port scanning, vulnerability scanning, or penetration testing against systems you do not own or lack written authorization to test.
- Launch or participate in denial-of-service (DoS/DDoS) attacks, amplification attacks, or any activity that disrupts networks or systems.
- Operate open mail relays, open proxies, open DNS resolvers, or open NTP servers usable for abuse or amplification.
- Forge, spoof, or falsify TCP/IP packet headers, email headers, or any part of a message or its routing.
- Run software that interferes with, degrades, or overloads our network or other customers.
3. Anti-Spam Policy
Fuyonet enforces a strict anti-spam policy. You must comply with the U.S. CAN-SPAM Act (15 U.S.C. § 7701 et seq.) and all applicable anti-spam laws.
You may not:
- Send unsolicited bulk or commercial email (UCE/UBE), whether the messages are sent from our network or merely reference a site or service hosted on our network.
- Send email to recipients who have not given verifiable, opt-in consent, or who have opted out.
- Use purchased, rented, harvested, or scraped mailing lists.
- Send email with false, forged, or misleading header information, "From" addresses, or subject lines.
- Fail to include a functioning unsubscribe mechanism and a valid physical postal address in commercial email, as required by CAN-SPAM.
- Operate "snowshoe" spamming, list-washing, or bulletproof-hosting operations, or host resources that support such operations elsewhere.
Mailing lists. All lists must be confirmed opt-in. You must retain proof of consent and honor removal requests promptly. We may require you to provide consent records on request.
Consequences. Spam-related violations may result in immediate suspension, rate-limiting of outbound mail, blocklisting cleanup obligations, and termination without refund. You are responsible for any damage to the reputation of our IP ranges caused by your activity.
4. Network and Resource Abuse
- Do not use Shared Hosting to run resource-intensive processes (persistent daemons, cryptocurrency mining, heavy background jobs, public torrent trackers/seedboxes) that impair other customers. Such workloads require a dedicated Server.
- Do not oversell or resell resources in a manner that causes abuse, unless expressly permitted by your plan.
- Cryptocurrency mining on Shared Hosting is prohibited.
- We may set and enforce fair-use limits on CPU, memory, I/O, inode count, process count, database load, and outbound connections.
5. Server-Specific Responsibilities (VPS / Dedicated)
- You are responsible for securing your Server, including OS patching, firewall configuration, and application security.
- Compromised Servers (e.g., part of a botnet, sending spam, hosting phishing) may be suspended immediately to protect the network, pending your remediation.
- You may not use a Server to circumvent the restrictions in this AUP.
6. Copyright / DMCA
Repeat copyright infringers will be terminated. See the DMCA section of our Terms of Service for how to submit an infringement notice to our designated agent.
7. Reporting Abuse
Report suspected violations of this AUP via our contact form. Please include relevant logs, headers, timestamps (with time zone), and IP addresses.
8. Enforcement
We may investigate suspected violations and cooperate with law enforcement. We may remove or disable access to offending Content, throttle or suspend the Services, or terminate the account. Where practicable we will give notice, but we may act immediately without notice where a violation poses a legal, security, or operational risk. Suspension or termination for AUP violation does not entitle you to a refund.
9. Changes
We may update this AUP from time to time. The current version is posted at fuyonet.com and applies to your continued use of the Services.
